Some Land Uses Don’t Mix: West End Library

Quoting the architect of the MLK renovation Francine Houben of Mecanoo who in the February 2022 issue of World Architects said:

I never thought it was a good idea to add a residential volume on this particular public building. A library — a public building — has very different ownership, maintenance, and sustainability issues than a residential building. In the end DC Libraries canceled that idea, and changed direction. I think that was a good decision on the part of the city.

Dear Members,   I am sharing DCPL’s official statement on the temporary closure of the West End Library.  

Due to a maintenance emergency, the West End Neighborhood Library will be closed for the next several weeks starting May 4. We will send an update when we have a specific reopening date.

Due dates for library materials checked out from the West End Library have been extended until reopening. Customers with active holds will be notified where to pick up their items next week, once they are moved

Robin – the information I received was that the damage was from an apartment above that led to water damages in the library. The repairs should take about 4-6 weeks (hopefully sooner!).

Perhaps that explains the terse notice. It is a public library, however, and information should be available to its owners – the public.

Housing Over Libraries

The latest difficulty (there have been several but this time it is flooding from a private living unit overhead) at the West End Library would seem to call for a hearing or roundtable on the pros and cons of housing being built over libraries, and of Public-Private Partnerships (ppp’s) generally. With three libraries — Deanwood, Rosedale and Northwest One — all proposed to be rebuilt with housing over them, we need a full understanding of what happened at West End and how we ensure it not happen again is needed. Options for our public library buildings such as combining with other civic uses should also be considered, as well as a complete understanding of land ownership and financing possibilities.

Under the Chevy Chase Small Area Plan recently published by OP, we have a large enough public property to combine the two civic uses — library and community center — together in one new building, while constructing affordable housing on the rest of the property around it, and thus avoid the potential for problems such as have occurred at West End. This exact concept was developed by Ward 3 Vision and is included in the Small Area Plan as one of three options. DCPL should endorse the concept proposed by Ward 3 Vision, and make clear that it is the best option for the Chevy Chase Library.

For now, we can avoid the issues experienced at the West End Library simply by not putting public and private together in one structure, an option open to us at Chevy Chase because of the size of the property. In view of the likely limited size of the other libraries being contemplated for housing over them, further examination is needed, and can and should be had.

Racine’s Tartuffian Endorsement of Silverman in “Opposing Developer Giveaways” || UNION MARKET COURT CASE NOV. 13

Washington, DC — As election day nears, the mailboxes fill with the latest electioneering propaganda including Elissa Silverman’s latest flyer showing DC’s Attorney General, Karl Racine giving robust endorsement of her at-large campaign.

With rhetoric like “Representing people, not corporations,” and “Opposing developer giveaways,” Racine is full throttle for Silverman while ignoring his own role in promoting corporate developers and giving away significant air-rights entitlements.

On a near weekly basis, Racine’s zoning attorneys provide the now infamous DC Zoning Commission with legal cover to approve major luxury projects citywide, resulting in land use approvals that greatly benefit the bottom-line of the Mayor’s corporate-developer friends while completely ignoring the impacts on existing DC communities and families.

For example, Racine and his zoning lawyers took no issue with the Zoning Commission rubber-stamping hundreds of new luxury hotel rooms & 6,000 new homes across 20 new projects at the blinging new Union Market, with the Office of Planning only brokering 10-units qualifying as “affordable” family-sized (3+ bedrooms) homes.  This type of valuable air-rights giveaway with little in return for existing DC residents holds similarly true for the deals at the Southwest Waterfront and Navy Yard developments, among others.

Racine’s band of top-rate OAG attorneys at the DC Zoning Commission include: Alan Bergstein, Esther Bushman, Hillary Lovick, & Jacob Ritting.  The veteran Alan Bergstein, Esquire, has been plying his trade for more than two decades in DC, directly playing a role in the massive displacement of black residents throughout the city without blinking an eye.

“Racine’s attorneys make it difficult for everyday people and impacted communities to engage in the zoning process and to actually win any permanent equity and compensation out of these disruptive and impactful luxury land deals,” said Ilaf Ayyash who was pushed out of the longtime artists incubator at 411 New York Avenue, NE for a luxury hotel project. “We had to fight just to be heard, and now the OAG is staking claim to the Zoning Commission’s indefensible positions in Court.  It’s such hypocrisy that Mr. Racine decries corporations and land giveaways when that is who his zoning lawyers excel at benefiting.”

Union Market Neighbors will be clashing with Racine’s lawyers again on November 13, 2018, at the highest Court in the District, the DC Court of Appeals, in seeking remedy from impacts due to another massive luxury project at 4th and Florida Avenue, NE. Changes to ZRR, Already

Tonight, Washington, DC, at the DC Zoning Commission, 441 4th Street NW, Suite 200 South, 6:30PM, Sep 22.

The Zoning Amendments Being Amended;
Ad hoc project for favored developer prompting consideration of substantial changes to the ZRR

Members of the Committee of 100 found that the Office of Planning was trying to define “substantial” changes to the ZRR as only “technical” changes.  There is a difference that requires a more public process for substantial changes.

Tonight, the DC Zoning Commission will be considering OP’s suggested changes, one which includes completely waiving the minimum area requirements for when developers request the city for a super variance, i.e. PUD applications.

EastBanc is asking the city for an entitlement to ignore the standards and rules regarding the minimum size of PUDs. However, the regs make clear that the Commission must not use their flexibility or discretion beyond what is allowable by law, which is why the Commission chose to have the hearing tonight.

The public is welcome to testify, but it’s hard to imagine what OP’s rationale could be for a substantial change that could invite a PUD to be dropped anywhere in the city, especially without comprehensive planning direction.

A report from the Hine School legal team tells favorably of efforts that resulted in the Deputy Mayor’s Office putting online a list of land abuse contracts between developers and DMPED.

There are noted issues, for example The Grimke School LDA Term Sheet reveals that the developer acquired the property for $25,000, while the appraisal indicates the property is valued at around $15-$20 million.
